Ouch Posted September 11, 2006 Share Posted September 11, 2006 Ok so the various rumors flying around got me thinking about iPod Video's and just how they would be used in public places etc. I wondered about a few things, for example - if you watch a movie on an iPod (or dvd player for that matter) on a bus, where someone can watch over your shoulder - does that constitute a public performance and hence a copyright infringement? Also what about movies that have restricted certificates - does watching Pulp Fiction on the bus with a 14 year old sitting next to me mean that i am allowing a minor to view an 18 ® certificate film? What about porn - presumably you could be arrested for watching that in a public place where minors could be exposed to it? well the porn is public indecency i would beleve, but the others are not worth anything because you are not intentionally making it a public performance, sorta like if you had a friend who you invited over to watch a dvd on your tv. also the 14 year old, if he has perental concent then its ok, also that applies to theaters and schools more than indeviduals becuase it was his choice to watch the movie, no one forced him to. thats my take on it max Link to comment Share on other sites More sharing options...

If you watch a movie on an iPod that belongs to you, it won't constitute a public performance because you're not playing it for masses nor asking money for it. It's like you invite a friend to watch a movie at your house, nothing wrong with it. Plus, if you bought a movie for an iPod, it's in the license that you bought that is meant to be played on a PORTABLE PLAYER, meaning you can play it anywhere you go. About the viewing the movie with a 14yo on your side, well, all you need to do is tell him that you're watching a movie for adults only, and he shouldn't be watching this.
