Question 1 - Yes, they should be ... to an extent. I think there should be clearly outlined limits to what can appear in an EULA so that these cannot be used to circumvent existing copyright laws (such as ones which allow for reverse engineering) or other laws. Question 2 - No, they kinda went over the top here. They hacked the software, bypassed protection systems, and then remarketed it. Not a good idea.
