I say yes IF the following conditions are met:

1. You have to agree to the terms PRIOR to installing the software via a popup of some kind which requires you to click a button to accept the terms.

2. The EULA is provided in writing for your review BEFORE you being installing the software, and that EULA matches the one presented during install.

3. The terms do not violate local, state, or federal law.

4. Each time there is an amendment to the EULA, you are notified and forced to agree or disagree to it.

 

I know it seems cumbersome, but no one can claim ignorance then.

 

As to why they are enforceable ... you entered into the agreement with your eyes open, too bad if you don't like the terms. No one had a gun to your head.
